Terms of Service

The service
Compliancefold is maintenance and compliance management software (CMMS) - equipment records, preventive maintenance schedules, and work orders - for facilities and the agencies that inspect and regulate them. It is provided by Richard LaCount Jr, a sole proprietorship in Topeka, Kansas, trading as Compliancefold ("we", "us"). By creating an account or using the service, you agree to these terms.
Accounts
You are responsible for the accuracy of the information in your account and for keeping your sign-in credentials secure. Accounts are for the person or organization they are issued to; do not share credentials. Tell us promptly if you believe an account has been compromised.
Acceptable use
- Use the service only for its intended inspection and facility-compliance purposes, and only for facilities and records you are authorized to access.
- Do not attempt to access another organization's data, probe or interfere with the service's security, or disrupt its operation.
- Do not upload unlawful content, or content you do not have the right to share.
- Do not use the service to send unsolicited messages of any kind.
Your data
You keep ownership of the records and documents you put into the service. You grant us permission to store and process them as needed to provide the service. How we handle personal information is described in our privacy policy.
Notifications
The service sends operational notifications by email, and by text message if you have opted in. Text notifications are optional and are never required to use the service - see our SMS notification terms. You are responsible for keeping your contact details current; notifications are a convenience and are not a substitute for meeting your own regulatory obligations.
Fees
Some plans are paid. Where a subscription applies, fees and billing period are shown before you subscribe, charges are processed by Stripe, and the subscription renews until cancelled. You can cancel at any time, effective at the end of the current billing period. Fees already paid are non-refundable except where required by law.
Availability and disclaimers
We work to keep the service available and accurate, but it is provided "as is", without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free.
Compliancefold is a record-keeping and workflow tool. It is not legal advice, and it does not determine or certify compliance with any fire code, regulation, or law. Responsibility for inspections, findings, and regulatory compliance rests with the agencies and facilities using it.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim arose.
Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate access that breaches these terms, or that risks the security or lawful operation of the service. On termination, we will make a reasonable effort to let you export your records first, subject to any retention the responsible agency requires.
Changes
We may update these terms. Material changes will be reflected on this page with a new date above, and continued use after that constitutes acceptance.
Governing law
These terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws rules, and the courts of Shawnee County, Kansas have jurisdiction over any dispute.
