Terms of Service

The service
Compliancefold is maintenance and compliance management software (CMMS) - equipment records, preventive maintenance schedules, and work orders - for facilities and the agencies that inspect and regulate them. It is provided by Sushifun LLC, a Kansas limited liability company trading as Compliancefold ("we", "us").
You accept these terms by ticking the box on your application to join, and by using the service. We keep a record of who accepted which version, when, and from which internet address.
Accounts
You are responsible for the accuracy of the information in your account and for keeping your sign-in credentials secure. Accounts are for the person or organization they are issued to; do not share credentials. Tell us promptly if you believe an account has been compromised.
Acceptable use
- Use the service only for its intended inspection and facility-compliance purposes, and only for facilities and records you are authorized to access.
- Do not attempt to access another organization's data, probe or interfere with the service's security, or disrupt its operation.
- Do not upload unlawful content, or content you do not have the right to share.
- Do not use the service to send unsolicited messages of any kind.
Your data
You keep ownership of the records and documents you put into the service. You grant us permission to store and process them as needed to provide the service. How we handle personal information is described in our privacy policy.
Your organization's or agency's owner or administrator can export all of its records and stored files at any time, on every plan, including while an account is read-only.
Health information
Compliancefold keeps records about buildings and equipment. It is not built to hold patient or other protected health information, and we do not sign business associate agreements. Do not upload patient information, including photos that show patients or their records. If some is uploaded by mistake, tell us and we will remove it. The file and its name are deleted, and the record it was on says that a file was removed and when. Copies in our backups are deleted automatically within 90 days.
An organization says, for each of its facilities, whether it serves patients, and keeps that answer up to date. The app reminds people adding photos and files to keep patient information out, and stops reminding them at a facility that says it serves no patients. Keeping patient information out remains your responsibility either way.
Notifications
The service sends operational notifications by email, and by text message if you have opted in. Text notifications are optional and are never required to use the service - see our SMS notification terms. You are responsible for keeping your contact details current; notifications are a convenience and are not a substitute for meeting your own regulatory obligations.
Plans and fees
Organizations can use the free plan, within the limits shown on our pricing page, for as long as they like. Paid plans are shown with their price and billing period before you choose one. Organizations' subscriptions are charged by Stripe, our payment service, and renew until cancelled; you can cancel at any time, effective at the end of the current billing period. Agencies are billed by a yearly invoice.
A price stated as locked for a term does not rise during that term. Any rise takes effect only when a lock ends, and we tell you the new price before then. Fees already paid are non-refundable except where these terms or the law say otherwise.
Founding organizations and agencies also agree to our founding agreement. Where it says more than these terms, it governs.
If a payment is missed
An organization's card is retried for about two weeks, and its owner is emailed and shown a notice in the app. If it is still unpaid 14 days after it was due, the account becomes read-only. An agency's invoice is due 30 days after it is sent, and we send reminders when it is due and 15 and 30 days after. If it is still unpaid 90 days after it was due, and after written notice to the agency's administrator, the account becomes read-only; inspections already started offline still sync.
Read-only means everything stays visible and can be exported, but nothing new can be added or changed. Paying in full makes the account writable again. We charge no late fees. Records are never deleted while an account is read-only.
Availability and disclaimers
We work to keep the service available and accurate, but it is provided "as is", without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free.
Compliancefold is a record-keeping and workflow tool. It is not legal advice, and it does not determine or certify compliance with any fire code, regulation, or law. Responsibility for inspections, findings, and regulatory compliance rests with the agencies and facilities using it.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data. Our total liability for any claim relating to the service is limited to the amount you paid us for it in the twelve months before the claim arose.
Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate access that breaches these terms, or that risks the security or lawful operation of the service.
Before we delete the records of an account that has closed or been terminated, we give its owner or administrator 30 days' written notice and a final chance to export them. We never delete records an agency is required to retain while that requirement lasts.
Changes
We may update these terms. Material changes will be reflected on this page with a new date above, and continued use after that constitutes acceptance.
Governing law
These terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws rules, and the courts of Shawnee County, Kansas have jurisdiction over any dispute.
